The Carnival Cruise Corp which is one of the largest operators of cruise ships is facing damages of up to two million dollars after a judge found that the cruise company had been faxing a travel agent between five hundred and forty and one thousand three hundred advertisements that were unsolicited throughout the course of a four year period. This in effect violated a federal statute.
The Judge from New York East District held the case that faxes sent violated the telephone consumer protection act dating back to 1991 which effectively bars the use of a fax machine in sending unsolicited advertisements.
Carnival Cruises raised a number of defenses to the case, which were rejected by the court.
